Three people at a table, one signing a contract

Many tenants sign a stamp paper agreement and assume everything is done. The Punjab Rented Premises Act, 2009 asks for a bit more: the agreement should be presented to a Rent Registrar. This guide covers that step. For a ready-made agreement, see our rent agreement format, and for your wider rights, see tenant rights in Punjab.

We could not load the Punjab government's own copy of the Act. The sections below are taken from a published transcription of the Act and legal summaries, and we name the sections we are confident about. Check the official text before you rely on any detail.

What Section 5 says

A landlord may not let out a premises to a tenant except by a tenancy agreement. The landlord presents the agreement to the Rent Registrar, who enters the particulars of the tenancy in a register, puts an official seal on the agreement, keeps a copy and returns the original to the landlord. A tenancy agreement entered by a Rent Registrar, or a certified copy of it, is proof of the landlord and tenant relationship.

The Act also says that this entry does not remove any duty to register the agreement under the general law on registration of documents.

What the agreement should contain (Section 6)

  • Details of the landlord and the tenant, including bank account details if there are any
  • A description of the premises
  • The period of the tenancy
  • The rate of rent and the rate of enhancement, if any
  • The mode of payment and the due date
  • The purpose the property is used for
  • The amount of security or advance

When rent is due (Section 7)

Rent is paid by the date written in the agreement. The transcription we read says that if no date is given, it is due by the tenth of the following month, and that if no payment method is given, payment should be by money order or bank deposit. Paying by bank transfer is a good habit anyway, because it leaves a record.

What happens if the agreement is not registered (Section 9)

If a tenancy does not follow the Act, the Rent Tribunal will not accept an application from the tenant unless the tenant deposits a fine equal to 5 percent of the annual rent in the government treasury. For the landlord the figure is 10 percent. In plain terms, you can lose the practical ability to go to the tribunal if you skip this step.

Steps to follow

  1. Agree the terms with the owner and write them into a tenancy agreement.
  2. Have both sides sign, with witnesses, on the stamp paper the agreement needs.
  3. Present the agreement to the Rent Registrar through the landlord.
  4. Collect the sealed original or certified copy, and keep it with your receipts.
  5. Also register the tenant with the police. Our tenant registration guide explains how.

Longer leases

Under the general law on registration of documents, leases for more than one year are normally required to be registered. Many agreements are written for 11 months for this reason. Ask a lawyer which route applies to your lease, because the rule can matter for how the agreement is treated in a dispute.

What we could not verify

  • Where in Lahore the Rent Registrar's office is and how to book or submit, since the official sources we found do not say.
  • Any registration fee or stamp duty amount for a residential tenancy.
  • Whether amendments after 2009 changed these sections.
  • How strictly the 5 percent and 10 percent fines are applied in practice.

This guide is general information, not legal advice. Laws and procedures can change. For a specific situation, speak to a qualified lawyer or the relevant office.
